Information collected through SMS Text Messaging can be shared with other current employees of Castparts Employees Federal Credit Union. The information collected is not shared outside of the credit union and is not shared with any SEG (Select Employer Group), including PCC.
We do not share your personal data with third parties for any purposes. Your information is only used by Castparts Employees Federal Credit Union and our SMS service provider to send you requested information and/or updates.
Access to your financial records, including SMS text communications, may be subject to the Right to Financial Privacy Act of 1978 (RFPA) (Rev. 2001)
- Under the RFPA, covered members are individuals or partnerships of 5 or fewer individuals. Corporations, trusts, estates, unincorporated associations such as unions, and large partnerships are not covered by the RFPA. Therefore, the availability of RFPA protection depends on the type of person or entity whose records are sought. SMS text messages may be considered part of a financial record depending on content.
- An FCU may disclose financial records to a government authority if the disclosure is required in accordance with any federal statute or rule. 12 U.S.C. §3413(d). The RFPA also has special procedures for requests from a government authority authorized to conduct foreign counter- or foreign positive-intelligence activities for purposes of conducting such activities. 12 U.S.C. §3414(a)(1)(A). In addition, the RFPA has special procedures for requests from a government authority authorized to conduct investigations of, or intelligence or counterintelligence analyses related to, international terrorism for the purpose of conducting such investigations or analyses. 12 U.S.C. §3414(a)(1)(C)
SMS text messaging is not exempt from regulatory requirements regarding the filing of a Suspicious Activity Report (SAR) with the Financial Crimes Enforcement Network (FinCEN), part of the Department of Treasury.
